XtractaursTM Secret Lab Contest
COMPLETE OFFICIAL RULES
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. MANY WILL ENTER, FEW WILL WIN.
1.
CONTEST PERIOD: The Xtractaurs
TM Secret Lab Contest ("Contest") begins at 12:01am (Pacific Time ["PT"]) on November 6, 2009 and ends at 11:59pm PT on December 6, 2009 ("Contest Period").
2.
ELIGIBILITY: Contest is open to permanent lawful residents of the 50 United States and the District of Columbia who are 6 -15 years of age, inclusive, at the time of participation. Siblings, children, and household members of officers, directors, employees, and agents of Mattel, Inc. ("Sponsor"), Pileated Pictures, LLC. ("Contest Administrator"), and their affiliated companies, parents, subsidiaries, and advertising and promotion agencies (collectively, "Contest Entities"), are ineligible to participate in this Contest. Contest is void in Puerto Rico, outside the United States, and where prohibited or restricted by law.

HOW TO ENTER: First, ask your parent for permission to go onto the Internet. Then, visit
www.xtractaurs.com/secretlab to receive instructions and details. If you are not already an Xtractaurs member, click on the "Get Started" button to visit Xtractaurs.com, where you can click on "Try It Free" to sign up as a free trial member and create customized dinosaur characters ("hybrids") in the Hybrid Creator. From the
www.xtractaurs.com/secretlab page, and follow the instructions to take a screenshot of your hybrid. Click on "Submit a Hybrid" to send your screenshot along with your hybrid’s name and a story about your hybrid. You must create and submit your hybrid during the Contest Period. Once you have completed your entry and submitted it online in accordance with the onscreen directions (your "Hybrid Submission"), you will be entered in the contest. You may submit multiple entries under the same parent/legal guardian e-mail, but a maximum of one winner per household will be selected. Any Entry Form may be deemed
ineligible by Sponsor, in its sole discretion.
Each contestant and his or her parent or legal guardian agrees, warrants and represents that a) each hybrid screenshot submitted by the contestant is the original work of such contestant, taken directly from Xtractaurs.com, b) the name and story provided in the Hybrid Submission contain no references to copyrighted terms or materials, c) no one else has any rights with respect to the Hybrid Submission, and d) the use of the Hybrid Submission by the Contest Entities will not violate the rights of any third parties. All Hybrid Submissions received become the sole property of Sponsor and will not be returned. Sponsor will own, in perpetuity, solely and exclusively, all Hybrid Submissions received in this Contest. Sponsor will not confirm receipt of Hybrid Submissions. Sponsor assumes no responsibility for late, lost, misdirected, damaged, illegible, or incomplete Hybrid Submissions.
4.
SELECTING THE SEMI-FINALISTS: Up to one hundred (100) Semi-Finalists (the "Semi-Finalists") will be selected from all eligible Hybrid Submissions on or about December 7, 2009, by the Contest Administrator, an independent judging organization whose decisions are final and binding in all respects. Odds of being selected as a Semi-Finalist depend on the number of eligible Hybrid Submissions received. The number of Semi-Finalists to be chosen is subject to change in the event there are less than one hundred (100) eligible entries. In that event, all eligible entries received will be selected as Semi-Finalists. In the event it is determined that any potential Semi-Finalist is ineligible to participate in this Contest, then such potential Semi-Finalist will be disqualified and another potential Semi-Finalist will be selected in his/her place. The Hybrid Submissions of the Winners will be posted on
www.xtractaurs.com/secretlab and
www.flickr.com/photos/xtractaurs for viewing by all users who visit such websites. At no point will the Semi-Finalists’ names or personal information be shared on these websites.
5.
SELECTING THE WINNERS: Provided that the Semi-Finalists chosen via the random drawing are in compliance with these Official Rules and are otherwise eligible for entry into this Contest, such Semi-Finalists will be eligible for Finalist judging. The Semi-Finalists’ Hybrid Submissions will be judged by a panel of judges consisting of Sponsor’s marketing and design professionals. The judges will select the ten (10) best Hybrid Submissions ("Winners") based on an evaluation of (1) creativity and (2) hybrids’ statistical effectiveness in the Xtractaurs.com Megavore Battles
TM. In the event two or more Semi-Finalists have submitted a Hybrid Submission where all of the elements of the design are identical, then the contestant who submitted the design online first will be eligible for judging and the other contestant(s) submitting the identical design will not be eligible.
6.
AWARDING THE WINNERS: The Hybrid Submissions of the Winners will be posted on
www.xtractaurs.com/secretlab and
www.flickr.com/photos/xtractaurs for viewing by all users who visit such websites. The ten (10) Winners are also eligible to receive First Prizes. Winners will be notified on or about December 13, 2009 via an e-mail to the parent/legal guardian e-mail address provided. The parent/legal guardian must respond with the parent/legal guardian’s name and valid mailing address. If a potential Winner cannot be reached by e-mail within seven (7) days from the first notification attempt, then such person will be disqualified. The decisions of the Sponsor relating to the judging of the contestants are final. In the event that the operation, security, or administration of the Contest is impaired in any way for any reason, including, but not limited to fraud, virus, or other technical problem, or any other causes beyond the reasonable control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, then Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Contest and select winners pursuant to such criteria as Sponsor establishes in its sole discretion.
7.
PRIZES: Ten (10) First Prizes: The ten Winners will considered for inclusion in an online showcase at
www.xtractaurs.com. The Prize also consists of a selection of Xtractaurs
TM products, at Sponsor’s sole discretion. The typical Prize will include an Xtractaurs
TM Starter Kit and four Xtractaurs
TM Figures. (Total value at Manufacturer Suggested Retail Price ["MSRP"] of $55.95) No transfer, substitution, or cash equivalent for prizes allowed except at Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize of equal or greater value if a prize cannot be awarded as described for any reason. Allow 4-6 weeks for shipment of prizes. The total approximate retail value of all the prizes is $559.50. All prizes will be awarded in the name of the contestant’s parent/legal guardian.
8.
CONTEST CONDITIONS: This Contest is subject to all applicable federal, state and local laws. Except where prohibited by law, each contestant’s Hybrid Submission and/or acceptance of a prize constitutes permission for the Contest Entities to use, publish, and display the winner’s Hybrid Submission in perpetuity, for promotional and marketing purposes, including but not limited to advertising, publicizing, and promoting the Sponsor’s products, without notification or additional compensation. In the event that a Hybrid Submission is used for promotional and/or marketing purposes, the Contest Entities reserve the right to reproduce it in full or modify it at their discretion without notification or further compensation. By participating, contestants agree to be bound by these Official Rules and the decisions of the Sponsor and the Contest Administrator. All decisions of the Sponsor’s judges and the Contest Administrator are final in all matters relating to this promotion.
10.
RELEASE AND LIMITATIONS OF LIABILITY: Winners and contestants agree to release, discharge, indemnify, and hold harmless Contest Entities from and against any claims, damages, or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Contest-related activity or participation in this Contest, including any claims relating to use, misappropriation, or disclosure of the Hybrid Submission or a claim regarding ambiguity of these Official Rules. Contest Entities are not responsible for late, lost, damaged, misdirected, incomplete, or undeliverable Hybrid Submissions due to a) system errors or failures; b) faulty transmissions or other telecommunications malfunctions resulting from any hardware or software failures of any kind; c) lost or unavailable network connections; d) failed, incomplete or garbled computer or telephone transmissions; e) typographical or system errors and failures; f) faulty transmissions; g) any problems or technical malfunction(s) of any telephone network or lines, computer online systems, servers or providers, computer equipment; h) entries not received by Sponsor on account of technical problems or traffic congestion on the Internet, or at a website, or any combination thereof; or i) any injury or damage to a judge’s or any other person’s computer related to or resulting from entering or participating in the Contest, judging the Contest or downloading any Entry Form for the Contest, or other telecommunications malfunctions which may limit a contestant's/judge’s ability to participate. Sponsor may prohibit a contestant from participating in the Contest, if, in its sole discretion, it determines that said contestant is attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair practices or intending to annoy, abuse, threaten or harass any other contestants, judges or Sponsor representatives.
